1. Agreement to Terms

By accessing or using ReadBuddy (the “Service”), including the ReadBuddy mobile application and website at readbuddy.ai, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and ReadBuddy (“we,” “our,” or “us”). By using the Service, you represent that you are at least 18 years of age or have the consent of a parent or legal guardian.

2. Service Description

ReadBuddy provides AI-powered reading comprehension tools and educational services designed to help children improve their reading skills through interactive reading questions and book analysis features. The Service uses artificial intelligence to analyze book cover images and generate age-appropriate reading questions.

3. Subscription Terms

3.1 Auto-Renewing Subscriptions

ReadBuddy offers auto-renewing subscription plans. When you purchase a subscription, it will automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. The subscription fee will be charged to your Apple ID account (for purchases made through the iOS app) or to your selected payment method (for purchases made through the website).

3.2 Subscription Plans

Subscription plans and pricing are displayed within the application or website at the time of purchase.

3.3 Free Trial

If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial expires. You will not be charged during the free trial period.

3.4 Managing Your Subscription

Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until the end of your paid period.

3.5 Restore Purchases

If you have previously purchased a subscription through the Apple App Store, you can restore your purchase by signing in with the same Apple ID used for the original purchase.

4. Payments and Billing

4.1 Apple In-App Purchase

Subscriptions purchased through the ReadBuddy iOS app are processed by Apple Inc. through Apple In-App Purchase. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

4.2 Web Payments

Subscriptions purchased through the ReadBuddy website are processed by Stripe, Inc. Payment is charged to the credit card or payment method you provide at the time of purchase.

4.3 Price Changes

We may change subscription prices from time to time. Any price change will take effect at the start of the next billing period following notice to you. Your continued use of the Service after a price change constitutes your agreement to the new price.

5. Refunds

5.1 Apple App Store Purchases

Refunds for subscriptions purchased through the Apple App Store are subject to Apple's refund policies. To request a refund, visit reportaproblem.apple.com or contact Apple Support directly.

5.2 Web Purchases

For subscriptions purchased through our website, please contact us at support@read-buddy.ai to discuss your refund request. Refund eligibility is evaluated on a case-by-case basis. Refunds for Apple In-App Purchases are handled exclusively by Apple.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Provide false or misleading account information
• Use the Service for any purpose other than personal educational use
• Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Upload content that is illegal, harmful, or violates intellectual property rights
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service in any way that could damage, disable, or impair it
• Use automated systems (bots, scrapers) to access the Service without permission

7. Intellectual Property

The Service and its original content, features, and functionality are owned by ReadBuddy and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you upload (such as book cover images), but grant us a limited license to process this content to provide the Service.

You are responsible for ensuring that any books or content you use with the Service do not infringe on third-party rights.

8. Disclaimer and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ReadBuddy provides educational tools and is not responsible for educational outcomes. AI-generated questions are intended as educational aids and should not be considered a substitute for professional educational guidance.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, READBUDDY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SERVICE.

9. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice within the Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you should stop using the Service and cancel your subscription.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
